RGB has passed away. I could not stand her but have respected her toughness beating cancer so many times. SHould Trump and the Turtle try to rush to fill her spot before the election? The left would go nuts (well more nuts).

Her dying wish on her death bed as dictated to a niece or some other relative is that they wait to fill her seat until the next President is in office

I can’t wait to see the Left spin this into her dying last breath request to delay the nom

“It’s what RBG wanted, we have to abide by her dying last wish” will be repeated over and over as the left’s rallying cry to block the nom

Trump will absolutely nominate someone. The question is what will Romney the Traitor, McCaskill, and Susan Collins do? Even if they vote "no" the VP can break the tie. The Turtle needs to bring it to a floor vote and if other Republicans defect, they should be voted out of office.

But this is the difference between the left and the right. If the shoe was on the other foot, the left would be unanimous in their vote. No doubt about it or questions asked. The Republicans think they can play nice and make allies. Graham thought if he voted for Sotamayor, he'd get the same couteousy with the next Republican pick (Cavanaugh) and it bit him in the ass. Fuck off Lindsay and bring it to a vote. Republicans are idiots.

IMHO, this is too important to wait until after the election. I feel fairly sure Trump will win and thus the Senate will remain Republican on his coat-tails but this is just WAY too important especially when John Roberts has turned out to be so wishy washy apparently caring more about what the media says about him than what the Constitution says on many things that have come before the court recently. Roe v. Wade is on the line. There may never be better chance to get rid of that abomination of a decision so many years ago that has led to the murder of millions of babies in the womb. If the situation was reversed there is ZERO doubt the left would rush this through.

Besides the left will pull so much BS in this election with ballot harvesting or any other type of fraud they can commit that there is a real chance the SCOTUS could have to intervene in the post election spectacle the left will create much like they did in the Bush / Gore year 2000 election. If the court is split 50/50 with Roberts being a dickhead we could have a real Constitutional crisis on our hands. Seating a true conservative justice who will solely interpret the Constitution rather than bow before the media like Roberts seems to like to do these days will be paramount.

And for any left leaning people who want to comment on this, if Biden is the apparent winner based on the Constitution and this comes before the court then they should rule in favor of him. I think the true Conservative justices would always rule based on the Constitution even if it goes against the right. The left leaning ones rarely do and almost never do when it hurts the left.

First off, let's put aside her last wishes because that has no basis in law or country. In fact, Ginsburg made her own death political by making such a wish public. Why wait for a new president? Is she hoping it will be a Democrat? To me this just proves she was a liberal ideologue all along and not a fair and objective justice. I don't take joy in anyone's death but I am not sad she will not be on the Supreme Court anymore.

And who says this is her last wish? Where is the proof it came from her? Is there a document? When was it written? RBG was getting cancer treatments back in the spring. She should have resigned then and not forced the country into what is about to happen. Her partisanship is why we face a potential constitutional crisis.

Trump should go ahead and appoint a replacement. This is exactly what Obama did when Scalia died. This way the senate can take up the debate, as they should. I never thought McConnell did the right thing with Garland. He should have held hearings and then Republicans could have rejected him, like Democrats rejected Robert Bork. I think McConnell spared Garland from being "Borked". At this point, Republicans have to consider the repercussions of going against what they said in 2016, no matter how nuanced it was then. But I am sympathetic to the arguments that Democrats would go ahead and confirm if the shoe was on the other foot. They are already talking about packing the court and eliminating the electoral college, two very radical proposals.

To me, fairness is not the issue. The Democrats have not treated Trump fairly since he was elected. They tried to stage a coup, then they tried to de-legitimatize his presidency. They resisted everything he did. Investigated everything he did. And their treatment of Kavanaugh was criminal. And let's not forget they impeached Trump in January just as coronavirus struck and IN AN ELECTION YEAR. If they can impeach in an election year instead of leaving it up to the voters, then we can confirm a Supreme Court justice.

If you are wondering what's at stake, the 1st, 2nd, 4th, 5th, 9th, and 10th amendments will be gutted if we have a majority of activists on the court. This is not hyperbole.

Lost on you is the partisan political hackery of the "dying wish" to have the seat remain vacant until after the election. If Scalia had done that, the Dems would be apoplectic and calling him a racist. NO SCOTUS member has ever lowered him/herself to such a purely political stunt.

It's a shitstain on the court and what it's SUPPOSED to stand for and can be and should be easily ignored. "Dying wish" my ass.

Great post Creeper but I disagree with your take on 2016. This wouldn't even be an issue if the Dems didn't do away with the filibuster. The threat of a filibuster forced the two sides to work together an compromise. But the Dems didn't want to do that. They just wanted to jam shit down everyone's throat and the chicken is coming home to roost. They can thank Harry Reid.

And all this talk about burning shit down has become the norm. Let's just get shit started and take to arms. Getting threatened at every corner is just not cutting it.........

Looked into the "dying wish" thing and the source is NPR, saying that RGB's granddaughter claims RGB told her that. No paper, no recording no video. Heresay. So RGB might not be the hack behind this stupidity, the granddaughter might be.

It still carries no weight and bears ignoring.

Trump should immediately nominate a black female for the spot, make the Dems attack a minority female.

The hypocrisy in here is rich.

McConnell and the Republicans literally just prevented the previous President from appointing a new Justice in his last few months and now all of you are demanding that Trump be allowed to appoint one, even closer to the election.

At least be consistent. What's funny to me is that you guys (Republicans on this board) have a win at all costs approach to politics but then you nonstop excuse Jerry's bullshit running the Cowboys the last 25 years. It's like you want to be sheep and are willing to justify anything that supports your ideology or worldview. I prefer debate and reason and those who can accept their own flaws and can admit when their guy or side screwed up.

If Trump wins the election in less than 2 months, no issues from me. I'm not thrilled about his potential selection but it's within his rights at that point.

If I offended anyone by calling you sheep, it probably means you are one,. If you think for yourself and want reasonable, consistent leadership from your representatives, you're not who I'm talking to.
