Alito and Thomas blood probably boil everyday having to deal with these complete lack of integrity losers.

I told you all when this case was first brought to the courts the SCOTUS would not throw out birthright citizenship. Roberts does not have the guts to make such a ruling, the same lack of courage he had when the court upheld gay marriage. If you have followed the court since Roberts joined then you know he will not upset the apple cart, which in this case is the problem of what to do with millions of anchor babies that have been in this country for years and were granted citizenship when they were born. They have enjoyed all the privileges of citizenship their entire lives. There was never a chance Roberts would rule to strip them of citizenship at this point. Barrett is just his lackey. He hates 5-4 votes on cases like this so he no doubt convinced her to vote with him for the good of the court.

At this point only an act of congress can change the ruling. Alan Dershowitz had an interesting idea on how to make fix this without a constitutional amendment. He suggested an act of law declaring that aliens, illegal or otherwise, are not subject to the jurisdiction of the US. This law would basically strip them of their 14th amendment right to citizenship. To avoid the Supreme Court overturning the law they would have to establish timeframes to allow past anchor babies to keep their citizenship.

It's either than or a constitutional amendment and that will never happen. The movement to establish a constitutional convention has 20 states but they need more and no Democrat run states are going to agree to it.

It doesnt take any fucking guts whatsoever. It's the right decision to overturn it. It's been abused for decades and has no business being applicable any longer.

This has nothing to do with guts and everything to do with corruption (again).

I think this statement supports birthright citizenship depending on how you define "subject to their jurisdiction". The obvious meaning is the person is subject to US laws. If that is the case, everyone without our borders is subject to US laws with the exception of certain foreign diplomats.

"All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside."

I think Senator Howard's explanation means birthright citizenship does not apply to those who are subject to the jurisdiction of another country but not the US, such as diplomats.

I don't think at that time lawmakers envisioned the problems we are having now with illegal immigration. It is impossible to determine what they intended in that regard. This is a problem for those useless bastards in congress to fix.

I think you missed the point. Call it guts, or whatever other word you choose. But ending birthright citizenship in the courts would essentially strip millions of anchor babies, many of whom are now adults, even old age adults, of citizenship. The court could not make up a law to deal with them. The court does not have the authority, for example, to stipulate their ruling only applies to anchor babies born since a specified date, or only those in the future. This is the kind of problem Roberts will always avoid if he can.

Now congress has to act. And they can.

But I have a question for the SC. What about pregnant women in immigration detainment centers. If they give birth do their kids become citizens even though their parent or parents are awaiting deportation?
