As of mid-February 2026, Kilmar Armando Ábrego García is in the United States and has been released from immigration detention. A federal judge in Maryland ruled on February 17, 2026, that he cannot be re-detained because his 90-day detention period passed, the government lacks a realistic plan to deport him, and a previous court order protected him from being sent back to El Salvador.

Following his release, Abrego García is free to live with his family in Maryland while he fights both his immigration proceedings and criminal human smuggling charges in Tennessee.
