A federal judge in Maryland ruled on February 17, 2026, that he cannot be re-detained because his 90-day detention period passed, the government lacks a realistic plan to deport him, and a previous court order protected him from being sent back to El Salvador.
Following his release, Abrego García is free to live with his family in Maryland while he fights both his immigration proceedings and criminal human smuggling charges in Tennessee.
