NFLPA files reply in court to collusion complaint involving Cowboys

MINNEAPOLIS — The NFL Players Association claims league owners have a “never-ending belief that they are above the law” in the latest court filing in a collusion complaint against the NFL.

The NFLPA filed its reply late Thursday to the NFL’s motion to throw out the case. U.S. District Judge David Doty will hear oral arguments Sept. 6.

The union wants to reopen a 1993 settlement that Doty oversaw until last year’s lockout, claiming owners set a secret $123 million salary cap during the uncapped 2010 season that cost the players at least $1 billion in wages. Washington, Dallas, Oakland and New Orleans were punished by the NFL for overspending in 2010.

The league has denied the accusation, arguing the 2011 collective bargaining agreement contained clauses precluding further court claims.

I'd very much like to see the players stick it to the owners for the 2010 collusion. In 2010, the owners acted unethically and screwed the players. It is obvious.

But surely the owners covered themselves against this litigation in the subsequent CBA.

I don't think the current CBA should have been able to preclude legitimate unknown claims from the prior CBA. Usually when a party waives any rights to litigate certain claims, they would have to know what claims they were waiving. The collusion from the 2010 "cap" didn't come out until right after the 2011 league year.
